CONTRACTOR RESPONSIBILITY TO SPECIFICATION IN BIDDING |
Looking for insight on this situation. Specification lists three manufacturers and product requirements (along with drawings). Contractor put one of the manufacturers in the GMP (presumably they got bids through a sub using said manufacturer). The shop drawing submission changed the product requirements significantly and the architect rejected them and stated the appropriate requirements (quoting drawings and specs). Manufacturer then stated they cannot meet the requirements. Contractor then went to another manufacturer listed in the specs to get the product. Contractor has now submitted a 50K change order for switching the manufacturer. Is this a valid change order to the owner?
