CONTRACTOR PROPOSAL QUALS AND EXCLUDES OVERRIDES DIVISION ONE REQUIREMENTS?
After a listing of qualifications and exclusions in a G.C.’s proposal, there is a line item defining closeouts with the typical Warranties, Product Data, As-Builts, etc., listed. The last sentence, however, reads: Qualification Close Out language shall supersede any Close Out Requirements of the Contract Documents, Project Plans and Specifications. Has anyone seen language like this?

DELAYED EARLY COMPLETION
Delayed early completion is a situation that occurs reasonably often. It’s when the contractor plans to complete the work ahead of the stipulated contract times, but then completion is subsequently delayed beyond the planned completion date, but is still within the contract time. When such delay is outside the contractor’s control, contractors often submit a change proposal or claim demanding additional compensation for the delay, even though the work is still within the contract times. It appears there is no clear direction on delayed early completion, based on court and arbitration decisions going back 30 years or more. In many cases, contractors have successfully (at least, partially successfully) pursued such claims. In other cases, the owner prevailed and did not have to pay additional compensation to the contractor when the owner delayed the contractor’s planned early completion. How have you seen this matter addressed? Was it ever challenged on a project? If so, how did it turn out?
