RETAINAGE GAMES PEOPLE PLAY
I have noticed some design professional consultants who have a cavalier attitude toward retainage in construction contracts (understandably) object strenuously when an owner attempts to impose retainage on the consultant in a new professional services contract. Retainage in professional services contracts is unnecessary, as is retainage in most purchase contracts (where an owner as “buyer” directly purchases materials or equipment from a “seller”, usually a manufacturer or wholesaler). Yet, some consultants do not appreciate why contractors object to having five or 10 percent, or more of their earned value held for months.
